YardWave Terms of Service
Version 1.1, effective October 10, 2026.
Summary
This summary helps you read the terms. It is not a substitute for them, and where they differ, the full terms control.
- YardWave helps you search the vehicles and parts at participating self-service salvage yards. We are not a yard. We do not own, sell, hold, inspect or guarantee any vehicle or part.
- The vehicles are typically old, damaged or no longer running. Inventory, prices, part availability, vehicle details and locations can be wrong or out of date. Confirm at the yard before you rely on them.
- Visiting a yard and pulling parts is dangerous. Each yard sets its own rules, fees and waiver and sells parts to you directly. Your visit and your purchase are between you and the yard, and you take on the risks of them as between you and us.
- One account works at every participating yard. When you join a yard, that yard receives your name and contact details.
- You must be 18 or older.
- Disputes with us are resolved by individual binding arbitration, not in court or as a class action, unless you opt out within 30 days (Section 16).
1. Who we are and what these terms cover
1.1 These Terms. YardWave is operated by Eduardo R. Salinas, an individual doing business as SiteWave Creative ("we", "us", "our"). These Patron Terms of Service (the "Terms") govern your use of our websites at yardwaveapp.com, the search tools we provide to participating yards for their own websites, our patron accounts, alerts and related services (together, the "Service"). Our Privacy Policy explains how we handle personal information and is part of these Terms.
1.2 How you accept them. You accept these Terms by checking the box that says you agree to the Terms of Service and Privacy Policy when you create an account, including when you continue with Google or another sign-in provider, and by using the Service after that. We keep a record of the version you accepted, when, and how. Searching without an account is also use of the Service; if you do not agree to these Terms, do not use the Service.
1.3 Yards. "Yard" means an independent business, such as a self-service auto salvage yard, that uses the Service to publish information about its vehicles, parts and prices. Yards are our customers, not our agents, employees or partners.
1.4 Yard staff. If you use the Service as an owner, employee or contractor of a Yard, your Yard's Subscription Agreement with us also governs that use, and these Terms govern your personal account.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to create an account. No one may accept these Terms for a minor. The Service is intended for users in the United States. You may not use the Service if we have previously suspended or terminated your account, or if you are barred from doing so under applicable law.
3. Your account
3.1 Registration and verification. Some features, including seeing a vehicle's row and space and saving search alerts, require an account verified by email (and, where offered, by phone). You agree to give accurate, current and complete information and to keep it up to date, including your email address and phone number, so that alerts are not delivered to someone else.
3.2 Signing in with another provider. If you sign in with Google or another provider, you authorize us to receive the information that provider shares with us for sign-in, such as your name and email address. That provider's own terms and privacy policy govern your account with it, and we are not responsible for it.
3.3 One account, many Yards. Your account is with us, not with any Yard. It works across every participating Yard, including when you use a search tool embedded on a Yard's own website.
3.4 One person, one account. Accounts are personal. Do not share your account, create accounts for other people, or create multiple accounts.
3.5 Security. You are responsible for activity on your account and for keeping your sign-in methods secure. Tell us promptly at hello@yardwaveapp.com if you believe your account has been used without your permission.
4. What the Service is, and what it is not
4.1 We are a search tool, not a yard or a seller. The Service is software that Yards use to publish information about their own vehicles, parts and prices. Each Yard is the sole source of that information: the Yard enters it, controls it, and is solely responsible for it. We host and display it for the Yard, and we do not create, verify or edit it. We do not own, possess, inspect, sell, hold or deliver any vehicle or part, and we are not a seller, broker, auctioneer or agent of any Yard or of you. We are not a party to any sale, visit or other transaction between you and a Yard. Any purchase is a contract directly between you and that Yard, on the Yard's terms.
4.2 Inventory and availability. Self-service yards change all day: other customers remove parts, and vehicles are moved, sold or crushed. Information about vehicles and parts, including whether a part is listed as available and when it was last checked, may be incomplete, inaccurate or out of date at any time. A part shown as available may already have been removed, and parts are available first come, first served. Nothing in the Service is a reservation, hold, promise of availability, or guarantee that a vehicle or part will be present when you arrive.
4.3 Prices. Each Yard sets its own prices, core charges, fees and taxes, and may change them at any time. A price shown as "from" an amount is the lowest price for that kind of part, and the price of the part you choose may be higher. Prices shown in the Service are for information only. The price that applies is the one the Yard charges at the time of sale. Questions about pricing, core returns, refunds or warranties must be directed to the Yard.
4.4 Vehicle details and compatibility information. Vehicle details such as year, make, model and engine are entered by the Yard or decoded from the vehicle identification number (VIN) using government and other third-party data, and may be wrong. Where offered, the Service may also indicate which vehicles can supply a particular part ("compatibility information"), derived in part from third-party data and from details recorded about each vehicle, either of which may be incomplete or wrong. A result labeled a "possible" match has not been confirmed against every relevant detail of the vehicle. Vehicle details and compatibility information are not a guarantee that a part will fit or work in your vehicle, and they are not professional or mechanical advice. Before you remove or buy a part, confirm that it matches your vehicle, for example by comparing part numbers and configuration.
4.5 Vehicle location. Row and space information is shown only to users who have verified their account and joined the Yard (Section 5). Vehicles can be moved, and location records can be wrong or outdated. Follow the Yard's instructions and staff on site.
4.6 Condition, safety and recalls. The vehicles at a Yard are typically old, damaged, inoperable, or at the end of their life, and their parts are used. We do not inspect, test or grade any vehicle or part and make no statement about its condition or safety. Photos and videos show a vehicle as the Yard recorded it, which may not be how it is now. Used parts may be worn, damaged, contaminated or subject to a safety recall. Parts that affect vehicle safety, such as brakes, steering, suspension, tires, seat belts and airbag components, should be inspected by a qualified professional before use. You are responsible for checking whether a part is subject to a recall, for example through the National Highway Traffic Safety Administration.
4.7 Yard visits are at your own risk and on the Yard's terms. Pulling parts from vehicles involves real physical risk, including from unstable or falling vehicles and parts, sharp metal and glass, fuel, oil, coolant and other fluids, batteries, airbags and other stored-energy components, heat, uneven and slippery ground, heavy lifting, tools, animals and insects, weather, and other visitors. Each Yard controls its own premises, entry requirements, minimum age, fees, safety rules, tools policy and waiver, and you must follow them. We do not own, operate, control or inspect any Yard or its premises, and we are not responsible for anything that happens during a visit to a Yard, including injury, illness, death, property damage, theft or loss. We provide no safety guidance; any rules or safety information you see about a Yard come from that Yard. Your acceptance of a Yard's waiver or rules is a matter between you and that Yard, and agreeing to these Terms is not agreeing to any Yard's waiver. You are responsible for anyone you bring to a Yard.
YOU KNOWINGLY AND VOLUNTARILY ASSUME ALL RISKS OF VISITING ANY YARD AND OF REMOVING, HANDLING, TRANSPORTING, INSTALLING AND USING ANY VEHICLE OR PART, INCLUDING THE RISK OF SERIOUS INJURY, ILLNESS, DEATH AND PROPERTY DAMAGE, AS BETWEEN YOU AND US.
4.8 Search tools on Yard websites. A Yard may place our search tool on its own website. When you use it there, these Terms and our Privacy Policy apply to your use of the Service, and the Yard's own website terms and policies apply to the rest of that website. We are not responsible for Yard websites.
4.9 Photos and videos. Vehicle photos and videos are taken and published by Yards. If one shows you, your information or your property and you want it removed, tell us at hello@yardwaveapp.com and we will remove it or blur it.
4.10 Errors and corrections. Information in the Service may contain errors, including in prices, vehicle details, part status, photos and videos. We and each Yard may correct, update or remove any information at any time, without notice. We are not responsible for errors in information a Yard provides.
5. Joining a Yard, and information shared with Yards
5.1 Joining a Yard. You may choose to join a Yard through the Service, which lets you see the row and space of its vehicles, save alerts for it and use other features it offers. When you join a Yard, we share your name and contact details with that Yard, and record that you joined it. We ask for your agreement each time you join a Yard.
5.2 What a Yard does with it. A Yard that receives your information uses it under its own policies, not ours, and may keep it even after that Yard stops using the Service. A Yard does not receive your search history, or any information about your activity at other Yards. To stop hearing from a particular Yard, contact that Yard directly. Our Privacy Policy describes this in more detail.
6. Alerts and communications
6.1 Alerts. You can ask to be told when a vehicle matching your search arrives at a Yard. Alerts are a convenience. We do not guarantee that an alert will be sent, sent promptly, or sent for every matching vehicle, or that the vehicle or any part will still be available when you receive it.
6.2 Email. By creating an account you agree to receive service messages by email, such as sign-in and verification messages, alerts you have requested, and notices about your account or these Terms. You can turn off alerts at any time in your account settings or from the unsubscribe link in each alert, and we act on it within 10 business days.
6.3 Text messages. Text messages are sent only if you check a separate, unchecked box agreeing to them. By checking it you agree to receive automated text messages from YardWave at the number you provide, including verification codes and the alerts you request. Consent is not a condition of any purchase or of using the Service. Message frequency varies with your alerts. Message and data rates may apply. Reply STOP to cancel and HELP for help, or contact hello@yardwaveapp.com. We may send one message confirming that you opted out. We send alerts only between 8 a.m. and 9 p.m. at your local time where we can tell it. If you change or give up your phone number, update it or reply STOP first, so that messages are not sent to its next holder. Carriers are not liable for delayed or undelivered messages. We do not share your mobile number or text-message consent with third parties for their marketing. We keep a record of your consent, including the wording you agreed to.
6.4 Electronic communications. You agree that notices, disclosures and agreements we provide electronically satisfy any requirement that they be in writing. A notice we email you is treated as received 24 hours after we send it, unless we learn that it was not delivered.
7. Acceptable use
You agree not to, and not to help anyone else to:
- use any robot, spider, scraper, crawler or other automated means to access, copy, collect or monitor the Service or its data, or use the Service to build or supply a competing product or database;
- collect, copy, republish, sell or otherwise distribute inventory, pricing, location or compatibility information from the Service in bulk, or for any commercial purpose other than buying parts for your own use or business;
- circumvent, disable or interfere with any access control, including the steps required to see vehicle locations, or any rate limit or security feature;
- share, sell or publish vehicle locations you see, or use them to enter a Yard outside its hours, without paying its entry fee, or in breach of its rules;
- reverse engineer, decompile or attempt to extract the source code or underlying data of the Service, except where the law expressly permits it despite this restriction;
- place an unreasonable load on the Service or interfere with its operation;
- create accounts by automated means or under false pretenses, impersonate anyone, or misrepresent your affiliation with any person or Yard;
- use the Service to harass, threaten or defraud any Yard, its staff or other users, or to collect information about other users;
- use the Service in violation of any law; or
- frame or mirror any part of the Service without our written permission, other than through a search tool a Yard has placed on its own website with our authorization.
We may investigate suspected violations, and may suspend or terminate accounts and report conduct to law enforcement where appropriate.
8. Our rights and yours
8.1 Ownership. The Service, including its software, design, text and the way information is organized and presented, is owned by us or our licensors and protected by intellectual property law. Vehicle, part, price, photograph and video information belongs to the Yards that provide it or their licensors. Some data, such as compatibility data, may be licensed to us by third parties on terms that do not allow redistribution.
8.2 Your license. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own purpose of finding and buying parts. All other rights are reserved.
8.3 Feedback. If you send us suggestions or feedback, you agree that we may use them without restriction or compensation to you.
9. Copyright complaints
We respond to notices of claimed copyright infringement under the Digital Millennium Copyright Act. If you believe material in the Service infringes your copyright, send our copyright agent (SiteWave Creative, Attention: Copyright Agent), at 20711 Wilderness Oak, Suite 107 PMB 3039, San Antonio, TX 78258 or hello@yardwaveapp.com, a notice that includes: your physical or electronic signature; the work you claim is infringed; the material you claim infringes it and where it appears; your contact information; a statement that you have a good-faith belief the use is not authorized by the owner, its agent or the law; and a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner. If material you provided is removed, you may send a counter-notice as the law provides. We terminate, in appropriate circumstances, the accounts of repeat infringers.
10. Closing your account, suspension and data retention
10.1 You may close your account at any time in your account settings or by contacting hello@yardwaveapp.com.
10.2 We may suspend or terminate your account or access to the Service at any time if we reasonably believe you have violated these Terms, created risk or legal exposure for us, a Yard or other users, or if we stop offering the Service. Where reasonable, we will tell you.
10.3 Inactive accounts. If you do not sign in to your account for 12 months, we may close it. We will email you before we do, and signing in before the date in that email keeps your account open.
10.4 What happens to your information. After your account is closed, we keep your personal information for 30 days and then delete it, except as our Privacy Policy describes: information the law requires us to keep, information subject to a legal hold, records of fraud or abuse, and the records of your acceptance of these Terms and of any text-message consent, which we keep for 5 years so that we can show what you agreed to. Information a Yard has already received under Section 5 is held by that Yard under its own policies.
10.5 When a Yard leaves the Service. If a Yard stops using the Service, its vehicles, prices and our records of your joining it are deleted from the Service. Your account and your use of other Yards are not affected. As Section 5 explains, that Yard may keep the contact details it already received.
10.6 Survival. Sections 4, 7 through 9, and 10.4 through 20 survive closure or termination.
11. Third-party services and links
The Service may link to or rely on services we do not control, such as sign-in providers, maps, email and text message providers, government vehicle databases, and Yard websites. Your use of them is governed by their own terms, and we are not responsible for them.
12. Disclaimer of warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE AND ALL INFORMATION IN IT ARE PROVIDED "AS IS", "WITH ALL FAULTS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY OR AVAILABILITY. WE DO NOT WARRANT THAT ANY INVENTORY, PRICE, AVAILABILITY, VEHICLE DETAIL, COMPATIBILITY, LOCATION, PHOTO, VIDEO OR OTHER INFORMATION IS ACCURATE, COMPLETE OR CURRENT, THAT ANY VEHICLE OR PART IS PRESENT, FITS YOUR VEHICLE OR IS SAFE TO USE, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE. ANY WARRANTY FOR A PART IS GIVEN, IF AT ALL, BY THE YARD THAT SELLS IT.
13. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW:
(a) WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, TIME, TRAVEL COSTS, DATA OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF WE HAVE BEEN TOLD SUCH DAMAGES ARE POSSIBLE;
(b) WE WILL NOT BE LIABLE FOR ANY LOSS OR HARM ARISING FROM A YARD, ITS PREMISES, STAFF, VEHICLES, PARTS OR SALES, FROM ANOTHER USER, OR FROM YOUR VISIT TO ANY YARD; AND
(c) OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS (US $100).
These limits apply whatever the legal theory, including negligence. Nothing in these Terms limits liability for our gross negligence or intentional misconduct, or any liability that cannot be limited under applicable law. Some jurisdictions do not allow certain of these exclusions or limits, so some may not apply to you.
14. Release of claims involving Yards and other users
14.1 Release. Because we do not operate any Yard and are not a party to your dealings with one, or with other users, you release us, and our owners, officers, employees, contractors and agents, from all claims, demands and damages of every kind, known and unknown, arising out of or connected with any Yard, any visit you make to a Yard, anything you do there, any vehicle or part you obtain there, any dispute between you and a Yard, or any dispute between you and another user, including claims about injuries, illness, death, property damage, vehicles, parts, prices, fees, refunds and warranties, to the fullest extent permitted by law.
THIS RELEASE APPLIES EVEN IF A CLAIM IS BASED ON OUR OWN NEGLIGENCE, INCLUDING A CLAIM THAT INFORMATION IN THE SERVICE WAS INACCURATE OR OUT OF DATE. IT DOES NOT APPLY TO THE EXTENT A CLAIM ARISES FROM OUR GROSS NEGLIGENCE OR INTENTIONAL MISCONDUCT.
14.2 Unknown claims. If you are a California resident, you waive California Civil Code Section 1542, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party." You waive any similar law of any other state.
15. Indemnification
To the extent permitted by law, you will defend, indemnify and hold harmless us and our owners, officers, employees, contractors and agents from any claim, loss or expense, including reasonable attorneys' fees, brought by a third party and arising out of your breach of these Terms, your misuse of the Service, your conduct at any Yard, or your violation of any law or the rights of a third party. This does not apply to the extent a claim results from our own negligence or misconduct. We may take over the defense of any such claim at our own cost, and you will cooperate with us.
16. Dispute resolution and binding arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS HOW DISPUTES WITH US ARE RESOLVED AND WAIVES YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION.
16.1 Informal resolution first. Before either of us starts an arbitration or a small claims case, the party with the dispute must send the other a written notice, personally signed by that party (not only by a lawyer), giving its name, contact details and the email on the account, describing the dispute and stating the relief sought. Notices to us go to hello@yardwaveapp.com and 20711 Wilderness Oak, Suite 107 PMB 3039, San Antonio, TX 78258. For 60 days after the notice is received, we will both try in good faith to resolve the dispute, and either of us may ask for a call or video conference that the person with the dispute attends personally (lawyers may attend too). All limitation periods and filing-fee deadlines are suspended while this process runs.
16.2 Binding arbitration. Any dispute, claim or controversy between you and us arising out of or relating to the Service or these Terms, including their formation ("Dispute"), will be resolved by final and binding arbitration before a single arbitrator administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules and, where they apply, its Mass Arbitration Supplementary Rules, except as stated in Section 16.4. The arbitrator decides all questions about the scope, validity and enforceability of this agreement to arbitrate, except that a court decides whether Sections 16.5 and 16.6 are valid and enforceable. The Federal Arbitration Act governs this Section. The arbitrator may award any individual relief a court could, and discovery and the right to present evidence follow the AAA rules.
16.3 Fees and location. Arbitration fees are paid as the AAA Consumer Arbitration Rules and fee schedule provide, under which the business pays most of them. If you show that the fees you would pay are prohibitive compared with the cost of a court case, we will pay as much of them as the arbitrator finds needed to make arbitration affordable for you. Each party pays its own lawyers' fees unless the law or the AAA rules provide otherwise. The arbitration will take place in the county where you live, or by video or written submissions, unless both parties agree otherwise.
16.4 Exceptions. Either party may bring an individual claim in small claims court if it qualifies, and may do so even after an arbitration demand is filed, as long as no arbitrator has been appointed. Either party may seek an injunction in court to protect its intellectual property or to stop a violation of Section 7.
16.5 Class action and jury waiver. YOU AND WE MAY BRING CLAIMS AGAINST EACH OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED OR REPRESENTATIVE PROCEEDING. YOU AND WE WAIVE ANY RIGHT TO A JURY TRIAL. The arbitrator may not consolidate more than one person's claims except as Section 16.6 provides, and may not preside over any class or representative proceeding. If a court finds this Section 16.5 unenforceable for a particular claim or request for relief, only that claim or request goes to court, where it is stayed until the individual arbitration is finished, and the rest of Section 16 continues to apply. It will never be decided in a class arbitration.
16.6 Mass filings. If 25 or more similar Disputes are brought against us within 90 days by or with the assistance of the same or coordinated lawyers or organizations, they are administered under the AAA's Mass Arbitration Supplementary Rules, and in addition: (a) each claimant's lawyer must certify that each demand has a reasonable basis in fact and law, to the standard of Federal Rule of Civil Procedure 11; (b) the Disputes are administered in batches of up to 100, with fees charged for each batch only when it starts; (c) every Dispute is decided on its own facts, and no decision in one binds any person who was not a party to it; (d) each party may take the discovery the AAA rules allow in each case; (e) limitation periods for Disputes not yet in a batch are suspended until their batch starts; and (f) after the first batch, either party may ask for a mediation of the remaining Disputes, which we will pay for. Nothing in this Section 16.6 limits the relief a claimant may obtain.
16.7 Your right to opt out. You may opt out of this Section 16 by emailing hello@yardwaveapp.com within 30 days after you first accept these Terms, with your name, the email address on your account, and a clear statement that you are opting out of arbitration. Opting out does not affect any other part of these Terms. If you have previously agreed to arbitrate with us, a later opt-out does not undo that agreement.
16.8 Changes to this Section. If we change this Section 16, the change applies only to Disputes that arise after it takes effect and of which we have not received notice. You may reject the change by emailing hello@yardwaveapp.com within 30 days after we notify you of it, in which case the version of this Section 16 you last accepted continues to apply.
17. Governing law and venue
These Terms are governed by the laws of the State of Texas and applicable federal law, without regard to conflict of laws rules. For any Dispute not subject to arbitration, you and we submit to the exclusive jurisdiction of the state and federal courts located in Bexar County, Texas, except for small claims matters.
18. Changes to these Terms and the Service
We may change these Terms from time to time. Changes apply only going forward, never to anything that happened before they take effect. For a material change, we will notify you by email or through the Service at least 30 days before it takes effect, except where a change is required by law or to address a security issue, and we will ask you to accept the updated Terms the next time you sign in; if you do not accept them, you may close your account. Other changes take effect when posted, and using the Service after that means you accept them. Changes to Section 16 are also governed by Section 16.8. We may change, suspend or discontinue any part of the Service at any time.
19. General
These Terms and our Privacy Policy are the entire agreement between you and us about the Service. If any provision is found unenforceable, it will be limited or removed only as far as necessary, and the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition or sale of assets, to an affiliate, or to a business entity we form to operate the Service, and we will tell you if we do. We are not liable for delays or failures caused by events beyond our reasonable control, including outages of internet, hosting, email or text-message providers, natural disasters, epidemics and government action. Nothing in these Terms creates an agency, partnership, joint venture, fiduciary or employment relationship, and no Yard or other third party is a beneficiary of these Terms. If these Terms are translated, the English version controls. Section headings are for convenience only.
20. Accessibility and contact
We design the Service to meet the Web Content Accessibility Guidelines (WCAG) 2.2, level AA. If anything in the Service is hard for you to use, tell us at hello@yardwaveapp.com and we will help.
